Parliament adopts substantial increase of court duties

On 22 May 2015 Parliament adoptedthe Law On Amendments to certain legislative acts of Ukraine regarding courtduty payment (hereinafter – the “Law”)*, which introduces new rates for courtduty to be paid in general, administrative and commercial courts.
In particular, the Law sets the following rates of court duty for submission togeneral/commercial/administrative courts:
• a material claim tothe court of the first instance - 1.5% of the claim's value, but not less than1 minimum salary;
• an immaterial claim (aclaim that does not have the potential for a negative financial outcome) to thecourt of the first instance - 1 minimum salary;
• an appeal claim – 110%of the rate for submission of the claim to the court of the first instance;
• a cassation claim –120% of the rate for submission of the claim to the court of the firstinstance;
• an application to theSupreme Court of Ukraine - 130% of the rate for submission of the claim to thecourt of the first instance.
Moreover, the Law does not establish the maximum rate of the court duty.According to the Law, the state authorities are obliged to pay court duty whenfiling to the administrative courts (before they were exempt from paying thecourt duty).
It is expected that the law will be signed by the President of Ukraine soon.
