DLA PIPER ADVISES BOMOND GROUP ON LONG-TERM LEASE AT TSUM

DLA Piper has advised Bomond Group, one of the leading perfumery and cosmetics
retailers in Ukraine, on obtaining preliminary lease within Central Universal Department
Store (TsUM) in the very center of Kyiv. Under the terms of the deal, Bomond Group
will take a long-term lease of mostly entire ground floor with the total area around 900
square meters upon completion of construction.
Kyiv TsUm is a landmark historical institution to be reopened in late summer 2016 after
reconstruction and will be the only and the most renowned high-end department store in
Ukraine. The location will feature approximately 41.000 square meters of highly
desirable retail space on Khreschatyk Street at the very heart of the city. Kyiv TsUM
will carry about 300 brands of medium plus and premium segments to be united as a
single department store, for the first time in Ukraine.
The DLA Piper Ukraine team analysed drafts preliminary lease agreement, lease
agreement and other contractual documents, supported Bomond Group in negotiations
with the landlord, incorporated amendments to the agreements during a number of
rounds of negotiations, and arranged closing of the deal as well as advised the client on
IP, tax and other legal matters.
The team was led by Natalia Kochergina, Partner and Head of Real Estate Practice,
with the key input from Oleg Matiusha, Senior Associate (Real Estate Practice). Illya
Sverdlov, Legal Director, and Associate Dmytro Rylovnikov (Tax Practice) advised
on tax matters, and Natalia Pakhomovska, Partner and Head of IP Practice and Senior
Associate Natalia Kirichenko advised on IP matters.
