Client Alert: Concerning restrictions on transfer of funds abroad 

Resolution No. 626 of the Board of the National Bank of Ukraine dated 3 October 2014, which entered into force as of 4 October 2014, has introduced changes to the Resolution № 540 of the Board of the National Bank of Ukraine dated 29 August 2014, concerning additional “anti-crisis measures”.

The Resolution No. 626 introduces exceptions from the general rule prohibiting settlements under import operations without actual importation of goods into the territory of Ukraine documented by an import customs declaration issued for more than 180 days. Namely, it allows settlement of respective payments (i) by agricultural producers; (ii) under transactions involving foreign export credit agencies; (iii) in respect of transactions under the letters of credits issued before 4 October 2014.

Moreover, exceptions from the general rule prohibiting settlements under import operations without importing goods into the territory of Ukraine have been introduced. Namely, the following settlements with non-residents are allowed: 

• Payment for travel, transportation and communication services
• Payment for services connected with the maintenance of air transport infrastructure and operating costs for the cross-border operating vehicles
• Payment for marine agency services and services related to chartering merchant marine fleet
• Payment by banks in discharge of their own obligations related to payment to correspondent banks, international communication systems; and certain others.

In addition to the previous anti-crisis restrictions on sale and receipt of cash funds in foreign currency, similar restrictions on banking metals have been imposed.

Please note that all of the above restrictions are in effect until 2 December 2014.

Client Alert: Про обмеження на переказ коштів за кордон

Постановою Правління НБУ № 626 від 03 жовтня 2014, що набула чинності з 04 жовтня 2014 року, внесено зміни до «Антикризової» Постанови Правління НБУ № 540 від 29 серпня 2014 року.

Постановою № 626 встановлено ряд виключень з загальної заборони здійснення платежів в іноземній валюті за імпортними договорами, за якими продукція була ввезена на територію України та здійснено митне оформлення на підставі ввізної митної декларації, дата оформлення якої перевищує 180 днів. А саме, дозволяється здійснення відповідних платежів (і) виробниками сільськогосподарської продукції, (іі) операцій за участю іноземних експортно-кредитних агентств та (ііі) операцій за акредитивами, що були виставлені до 04 жовтня 2014.

Також були запроваджені виключення з загального правила щодо заборони зі здійснення розрахунків за імпортними операціями без ввезення товару на територію України. Зокрема дозволяється здійснення розрахунків із нерезидентами за наступними операціями:

• з оплати туристичних, транспортних та комунікаційних послуг;
• з оплати послуг, пов’язаних із забезпеченням функціонування авіаційної транспортної інфраструктури та експлуатаційні витрати для транспортних засобів;
• з оплати послуг з агентування і фрахтування морського торговельного флоту;
• з оплати банками власних зобов’язань, пов’язаних зі сплатою коштів банкам-кореспондентам, міжнародним системам зв’язку; та інші.

На додаток до встановлених раніше антикризових обмежень щодо продажу та видачі (отримання) готівкових коштів в іноземній валюті, були запроваджені аналогічні обмеження й щодо банківських металів.

Нагадуємо, що всі зазначені обмеження діють до 02 грудня 2014 року.
